Names, such as product names or company names are typically protected with trademarks. My first advice is to ask a patent attorney or an attorney experienced in trademarks to help you with protecting your name as a trademark. But if you want to get a glimpse of what is needed to do this, then here are the most important things to consider: First of all, you would want to compile all the information you need to protect a name as a trademark. The main three pieces of information would be: a) The sign (e.g. name or logo) b) The goods and services c) The applicant Goods and services are grouped into so called Nice classes, as you will see in the following example: If you want to open a dance studio under the name MARIMBA then this information would be a) Sign: MARIMBA b) Goods and services: 41: Education, entertainment and sports (including e.g. dance clubs, dance instruction, …); 43: Provision of food and drink (e.g. a bar); 25: headwear; clothing; footwear c) Your company name and address or personal name and private address Before protecting a name as a trademark, you find out, whether there are earlier identical or similar trademarks that could cause a conflict. As an example, you do not want to launch a new car under the name of PMW – it would be too similar to BMW. I have a link to a detailed video in the shownotes how to conduct a search for earlier similar trademarks. Once you made sure that there are no conflicting earlier trademarks or company names, then you can actually file your trademark application with the intellectual property office of your country or region. Many trademark offices nowadays offer to file trademarks using a simple web form. You can navigate there and then enter the information that we compiled above. Once submitted, you can a receipt and the office will then start examining your trademark application. The trademark gets registered, if the office did not find any formal errors or did not object to the trademark application for other reasons such as descriptiveness of the mark. Once your trademark is registered, you can use the trademark e.g. to tell other competitors not to use identical or very similar names for the protected services. Or you can issue licenses to your trademark for other dance studio owners and make money that way. I hope I was able to show you how to protect a name or business name. We are constantly bombarded with so many icons and logos that we rarely stop to look further into them, but there are some very interesting and bizarre secrets hiding within these 10 famous logos! 1. Hyundai Bet you think the H logo is just the first letter of the South Korean car manufacturer Hyundai? Of course you do! But it actually represents two figures: the happy client shaking hands with the Hyundai salesman, cleverly projecting the subliminal message of a successful car purchase. 2. Apple It was Rob Janoff who was tasked with creating the apple logo back in 1977. Janoff bought a bag of apples and spent the week sketching them, trying to represent the perfect angle where the fruit couldn´t be mistaken for a cherry. This was when he added a bite mark and stumbled across the similarity between Bite and Byte. This was definitely a selling point for Steve Jobs. 3. Vaio The first two letters in the computer company's name symbolize a digital waveform and the io is designed to look like a 1 and a 0, representing binary and the mix of analog and digital. Also the melody that sounds on startup actually derives from the dialtone sounds on a telephone keypad on typing V-A-I-O 4. Amazon Always aiming to please, Amazon designed their logo to represent a smile, projecting a sense of satifaction in their brand. Not only that, but the arrow also starts at ´a´ and finishes at 'z' implying that the company stocks every product you could possibly desire. 5. Toyota T-o-y-o-t-a. All the letters of the companies name can be found within the logo. But what does it represent? You're thinking A big strong buffalo's head or a cowboy with a hat, right? Wrong! It actually represents a needle and thread! This Japanese car manufacturer actually began making weaving machines and keeps its logo to this day! 6. Continental Sometimes overlooked, the continental logo is simple and clever. The first two letters are designed to symbolize a car wheel. 7. Toblerone This awkward-to-eat chocolate treat doesn't just have a simple mountain in its logo. Toblerone is made in Bern, Switzerland, so it´s no surprise to see one of the Swiss alps in its logo. But it also hides a secret bear hidden in the mountain, as Bern is known as the city of bears and the bear symbol is heavily decorated throughout the city. 8. BMW The German motor company started out making airplanes in 1916 and many think that the checker pattern in its logo represents the spinning propellers of an airplane. But it is actually just the design of the Bavarian flag, the part of Germany where the company originated. 9. Domino's Pizza In 1960 College dropout Tom Monaghan borrowed $900 to by a tiny pizza placed called Dominic's. 5 years later he bought 2 more locations. The former owner refused Tom the permission to use his name in the franchise so Tom turned it into Domino's. The dice in the logo represent the first restaurant that he bought, followed by the next two, and he had planned on adding numbers on every new opening. That was before he realized how big the franchise would become. 10. Unilever Who is Unilever, right? It's actually a huge corporation which owns over 400 famous brands. You've only got to look on the back of any of these popular products to find their logo hiding there. (Axe, Lipton, Ben and Jerry's, Dove, Heartbrand, Hellman's) But that's not all, the actual unilever logo is made up of 25 smaller logos, each with a rich meaning. It is important to always do a thorough trademark search BEFORE applying for a trademark through the USPTO. Once you file, you cannot get your money back. So make sure there is no one else using your trademark before you apply. You can do this by searching the internet. Search for domain registrations that may be similar. Search on Google. You can Thomson Thomson to run a detailed paid search. You should also try to pick "arbitrary and fanciful" names as opposed to suggestive and descriptive terms. In other words "Nike" or "Xerox" are better names than "Sports Shoes Company" or "Copy Paper Inc." Be creative - think out of the box. Also, keep in mind there are many different things you can get a trademark (for goods) or service mark (for services) for. Examples are: 1. Your company logo 2. A slogan you use in your business 3. Nicknames (ex. "Johnny Football") 4. Your business name These are just a few of the common examples. At any rate, this video should help you understand what lawyers do when filing a trademark. Should you keep all of your products together under a company umbrella or have separate identities? Let’s talk business goals and marketing tonight. Don’t launch a product on a squeaky clean account with 0 followers and no brand recognition!!! Sometimes it makes sense to fragment yourself, such as splitting business and personal accounts where something is not appropriate or doesn’t belong on your single account. But remember, you are doubling your work!! Bridget - it’s like a ‘stock split’ - you have twice as much stock, but it’s worth half as much If you have lots of products and each product has its own accounts, then every time you launch a new product, you have to start over from scratch! James doesn’t necessarily like being as fragmented as he is, but it kind of made sense to do so. The current brand he is working on now happens to be in a different industry. Sometimes fragmenting makes sense as a way to protect each of your ‘products’ or ideas from each other. If you are selling a very low value product with one part of your business but then also selling custom site development for several thousand with your agency, you may want to separate them to the cheaper solutions don’t devalue your main brand Sometimes there are also business, financial, tax reasons to separate out as well Bridget wonders what happens if she changes her name - her brand uses her current name, so can she keep her brand name or does she need to change it? ...Should you have a company name instead of using your name? The same thing happens with your company - The company, the product, and you are all identities - what is the best way to brand yourself? Do you want to be a house of brands or a brand of houses? (Chris Lema) When you’re a giant company - you can have multiple separate teams for each of your products, but if you’re a small business, it’s hard to have the necessary resources to work on building each of those separate brands successfully and it likely makes more sense to concentrate your efforts on one brand! You don’t want to find yourself in the position where you realize you haven’t tweeted or posted in several days on one of your brands - fragmenting yourself creates that risk Go ahead and reserve the twitter (social media) handles and/or website domains and then you can phase in your efforts later as your company grows. Essentially ‘flag planting’. If you’re going to fragment - go ALL in. Be cognizant of how much time it takes to build an account from scratch; it takes a LOT of time! If you are fragmented with 2 or more accounts, another question is whether it makes sense to merge them and delete one of the accounts. The risk from merging is that you’ll lose followers from both accounts. James has an individual domain name and social account for all of his brands CONS: Money, resources, obscurity (starting from scratch can be good if you have a bad reputation, but not so great if your reputation is a good one) When you have multiple brands, sometimes there is brand confusion - where clients will say “oh, I didn’t know you did that too” ….
